Please post an image showing both figures in grey, the texture isn't needed to show the problem and is against the forum TOS.

do you mean the figure inside DAZ3D?
This is so as I bought it from the site. I do not know how to make it gray.

In 3ds i removed the texture because it uses too much ram.

    can you help me?

You may need to wait a bit for a reply, not many use Max here.
    But
I get funny joints sometimes on FBX export to iClone if the figure uses JCMs (joint controlled morphs, Blendshapes in Max).
    If that is any help.
I cannot really fix it just hide it under clothes etc
You may need to apply [those morphs or use whatever Max has for ERC.
How DAZ does it is here

The problem is only when I export the model with a pose. If I export the model in "T" pose I have everything working correctly :/

Please don't bump threads - as wendy says, this isn't a chat room and it's not unusual for a reply to take a while.

In this case, I think your issue is probably a limitation of FBX, and quite possibly the destination software even if FBX was more obliging. The DAZ figuers in DS use separate weight maps for each rotation, FBX and the limited number of 3D suites that I know use a single map, so going from DS to one of the other applications via FBX always involves some compromises. You can get a preview of the result by using the Edit>Figure>Rigging>Convert to General Weight mapping command in DS.
