may the basic genesis geometry be redistributable ?

PadonePadone Posts: 4,014
January 2022 in Blender Discussion

I could provide a free softbody system for genesis that works in blender. But I need to redistribute the basic genesis geometry to include custom maps that I made for the softbody system. I know other works redistribute the genesis geometry, as the free clones by Catherine for example https://www.daz3d.com/forums/discussion/491296/.

I also opened a ticket on this and I'm waiting for a reply but I'm not sure about the category I chose "boost for daz".

By reading the EULA it seems this may be possible under certain conditions. Since the softbody system will require a daz figure to work it may be already compatible with the EULA.

Three Dimensional Works. DAZ wishes to encourage the expansion of the catalog of Content available to its users. Accordingly, User may access, use, copy, and modify the Content to create one or more derived or additional three-dimensional works provided that:

  • any such derived or additional three-dimensional works are designed to require or encourage the use of Content available through the online DAZ store either by (i) requiring the use of such Content to function, or (ii) allowing only limited function when not used in conjunction with Content from the online DAZ store; and
  • upon receipt of a written request from DAZ, User will immediately cease any and all distribution of the derived or additional three-dimensional works User has created from the Content, if DAZ has determined, in its sole discretion, that (i) such additional or derived work is substantially similar to or is a clone of existing Content; or (ii) such additional or derived work fails to require or encourage the use of Content available through the online DAZ store as described above.

Clones are morphs, they don't include the base figure geometry only deltas to modify it.

I don't know what exactly would be needed for your system but usually redistribution of any part of the content itself is forbidden. You'll have to wait for an official answer to your ticket.

you can always ask DAZ to distribute it themselves as a "product"

Well makes little sense since the basic figures are distributed "free" anyway by DAZ, plus I don't need materials rig and morphs just the geometry alone means very little by itself and it's not "usable" anyway. But I see your point and I'll wait for an answer by DAZ. Thank you.

@Leana On a second thought I'm not sure you're right. The EULA clearly states as below if I just quote it short. Then the genesis basic shape with custom maps is a derived work, and it does require the daz content to work. So this really seems already compliant with the EULA. If I'm wrong, where exactly ?

Then sure DAZ can ask to "cease any and all distribution in its sole discretion", but this is true for any "derived work" aka genesis figure around.

"User may copy the Content to create one derived work provided that it's designed to require the use of Content available through the DAZ store by requiring the use of such Content to function."

    update.

No needed anymore, Thomas found a way to work around this. If I may do a constructive comment, personally I believe DAZ should make an effort to be a little more "friendly" to those who want to contribute. Hiding behind "unclear" EULA statements doesn't help.

For the record didn't receive any reply from DAZ on my ticket.

As I have understood it, one can not include any part of a DAZ store bought product in ones own product unless the store bougt product was a merchant resource.

"Any part" as in not one coordinate, unless the coordinate on your product just happened to land on the same location by accident and not one pixel from someone elses textures or maps
