Hello everyone,
I was wondering if it is ok to use a Render from DAZ3D to enter an Art Contest for an MMO Video game?
The rules of this contest state:
"It has to be however artwork of your own making.
The participant needs to the creator of submitted image holding all legal rights attached to it.
All submissions found to be not creative work of the player submitting it will be removed and are not eligible to win a price."
We do not gain any legal rights to the models we pay a license to use them right? So I am wondering if a DAZ3D render could be used in such a contest.
Thoughts?

Do the terms of the contest grant them the right to use the models or only the rendered image? Assuming the latter, which is usual, then yes the Daz license would certainly allow you to use the content to create a render for a contest.
You are asking to use your own renders, not others correct?
As Richard mentions, as long as the judges don't expect the actual models used in the render to be redistributed and the images you used are your own that you created, shouldn't be an issue.
You need the contest creators to clarify what they mean by all legal rights. It's a rather broad statement.
You have all legal rights as long as it is only the render. If the model or scene file has to be submitted, then that is a different story. The models, shaders, etc., are not part of the contract we have with Daz or the Daz Marketplace. Only the renders, stills or animations, belong to us users. Or to think of it another way, the things we produce with the tools Daz/Rendo/etc sell us. The tools themselves (Victoria or Michael or whatever) we can use, but we don't own the rights to give them away, sell them, or enter them in contests under our names.
Now if the contest is about making a model, then rendering it in a scene or whatever, they won't allow models someone else made. If its only about the image itself, then you are good.
If this is the game I think it is
then it's only the image that is submitted, no scene files models etc. It is a pirate related fanart of the game and the entries encompass a wide range of media and skill levels, along with lots of pirated entries
. Alas, there are a few "art snobs" on the forum too
.
I have submitted an entry, but, will replace it with one I'm working on now, 5 days left to perfect it....
I highlighted the most important line. When you buy assets from Daz vendors/PA's, you hold the right to use them for your own artwork and renders, as well as changing them to suit your needs. The renders are our own copyright, similar to a photographer setting up a scene, arranging lights and hiring actors/models. The general trend in art is moving towards increased outsourcing. It is simply more efficient for many artists to buy and own large libraries of assets than to create everything themselves. I think the outsourcing idea is fine as long as there is honesty involved.
Unrelated to this case:
It is not allowed to share the purchased tools with others, including all the technical files such as textures, OBJ's, et cetera, that's the caveat. Then, there are specific Merchant Resources that can be used for products that are sold, but they are clearly labeled regarding this.
Also unrelated to this particular case: Game developers need to buy specific licences from individual vendors in order to use those assets in their games. Since you are not a game developer, you won't need those additional licences.
I think you might be right.
Thanks everyone for the Clarification! Seems everyone agrees on this one.
