It would have to be a freebie or a freebie texture of a commerical product. For some reason no one is allowed to make commerical products that are obviously based on a Marvel character.

Free is allowed due to fair use that fan-art seems to get by on.

yep. but there are public domain characters like the billy batson fawcett captain-marvel, http://pdsh.wikia.com/wiki/Captain_Marvel_(Fawcett) mary-marvel, the question, uncle sam, the first two blue beetles, and others like the lev gleason 1940 ddaredevil, that are free use, so i'm not sure why Daz isin't taking advantage of them. niether marvel nor Dc can do anything about it legally for those. http://pdsh.wikia.com/wiki/Question
There is an IRAY superhero fabric pack that has the pattern but no logo. You would also have to have a body suit and mask with the proper surfaces. There are several free spiderman suits available for Michael 4.

I am not sure I would trust that web site 100%. DC purchased the copyrights from Charlton decades ago and has published occasionally to defend them. I doubt that a company like DAZ would want to contest this with a company with more high paid lawyers as I have arm hairs. Just sayin'
The characters aren't public domain – the comics in which they appeared, however, are not covered by copyright (due to a renewal requirement that was not met), and there are at least two Golden Age comic archive sites at which you can read them up to around 1952 or so. However, they are character names (like Daredevil) and images (like Fawcett's Captain Marvel) that are still being used by Warner/DC and Disney/Marvel and are covered by trademark law. So yah, commercial use won't fly.
I am not a lawyer. But I did invest in a documentary feature in which a big chunk of the budget went to intellectual property 'coverage'.
they published an improper copyright notice in the 1970's. once they did this, the characters they own which had that notice, lapsed into the public domain. there is no such thing as "international copyright". fact. they are all public domain except the newer dirrivitive versions. trademark is different. but thats just a name on the cover, or title of a film. simply change the trademark, and you can legally use the real names on the interior pages/comics/films/series. trademarks do not cover interior work. just cover titles.
