Questionable Marketing
This is pretty questionable marketing... I have tried to stop commenting on these events, even when they bother me, but this one has really irked me.
The attached screenshot shows, on the left, the email I received this morning. On the right is the rotating banner from the main shop site.
On the email, no mention of any extra conditions to the sale.
On the banner, nothing other than "click here for details" in extremely subdued gray.
No mention of any additional conditions. No stars denoting that there might be additional purchases required.
But go to the actual page, "when you buy or own the Undead Creature Creator HD Morph Pack for Genesis 3 Female"
This is wrong.

In each of those screenshots I see the words "Click for details"; that's where the information is.
US FTC regulations state that unfair or deceptive acts or practices in or affecting commerce are unlawful. (15 USC § 45 (a)) In relevant part, they state that contingent conditions and obligations of an offer must be set forth clearly and conspicuously at the outset of the offer, and that disclosure of the terms of the offer set forth in a footnote of an advertisement to which reference is made by an asterisk or other symbol placed next to the offer, is not regarded as making disclosure at the outset. (16 CFR 251.1)
Show me where you see something that complies to the above.

Once again, the "Click for Details" states what the offer entails. Stating regulations are not needed as nothing is deceptive about clicking a link for more detail on a offer, especially when it is clearly displayed for you on the very images you produced.

Thank you. That is all I was asking for. Every other email I receive with sales announcements that include similar conditions always list those conditions at the bottom of the email.
I never questioned the validity of the sale, just the manner in which they have been getting communicated recently.
Often times including the entire offer in an email or a banner is not the best route. So I doubt we will do that. But we will make it much more clear that there are additional terms or requirements, and how to get to those for more information.
