3D models usage

The Licensing Agreement is written in "legalese" Is there a plain English explanation of how the 3D model can be used? I don't want to buy something and then later find out I am violating the usage terms. Thanks.

  • With limited exceptions for the Anne Marie Goddard Digital Clone, as desscribed on the product page, you can use 2D still images and aniamtions as you wish. Anything that would involve sharing the 3D assets or plain textures with others, even in encrypted form, is not allowed other than in limited circumstances with a Game Developer License.

     Renders and animations only unless you have a game developer license.

    The EULA says
     

    Terms of Use. Two Dimensional Works. Subject to the terms and conditions of this Agreement, User may (i) access, use, copy and modify the Content in the creation and presentation of two-dimensional animations and renderings, (ii) incorporate two dimensional images (including two dimensional images that simulate motion of three dimensional objects) derived by User from the Content in User’s other works, and (iii) publish, market, distribute, transfer, sell or sublicense User’s two-dimensional animations, renderings and other works; provided that User may not in any case publish, market, distribute, transfer, sell or sublicense any renderings, animations, software applications, data or any other product from which any Content, or any part thereof, or any substantially similar version of the Content can be separately exported, extracted or de-compiled into any re-distributable form or format.
     

     

    And

    • Restrictions on Copying. The Content is provided for User's exclusive use. User does not have the right to provide the Content to others in any form or on any media except as set forth in this Agreement. The Content may be copied in whole or in part for User’s exclusive use. Specifically, User may copy the Content onto the storage device of an unlimited number of computers owned or controlled by User. The Content is for User’s exclusive use and no other individual or entity. Each individual must obtain his or her own license to use the Content.

    Which means you can copy the content you buy on to any number of computers as long as they are all your computers, Each person who wants to use the content has to purchase their own copy. You can then render and sell or whatever you want to do with anything you produce with that content, as long as it is 2d, ie images, videos and animations. However you have to make certain that no part of the content that you have bought can be extracted from anything that you sell or otherwise redisrtibute.  So you cannot, for example, re-distribute any textures in such a manner that they can be used without needing the purchased item. You also cannot allow any one else to use your content nor give them a copy of it to "TRY"

    3d items, ie if you want to make a 3D model of a Daz 3D model, can only be for personal use.  You cannot make 3d models of Daz content and sell them.

    Absolutely verboten, without a game dev license, is using the content geometry (ie the actual mesh of the model)  and if it is used the terms of the Game dev license EULA must be adhered to.  THere is a separate EULA section for Game development

    Can I just ask a quick question about the game development side then?

    From reading through Chohole's excellent description, it appears that I can use models if I'm creating a "Visual Novel" without having a game license - the images are going to be 2d images in layers, rather than 3d models, and they will be... pre-rendered, so no way to extract components. There might be multiple layers used - so a rendered background, a rendered character, a separate rendered hairstyle, rendered outfit, but none of them will be anything except 2d images. 

    Am I right in assuming that that is ok as per the license as stands, or do I have to get a game license since it will be a "game"?

    No that is fine,  It is only when the game uses the actual model mesh that the Game dev licenses come into the equation.

    Is that also the case for the 3rd party artists on here as well, or just Daz originals? (Only just thought of asking that one otherwise it would've been in the previous reply!)

    Yes   DOs and PA products both.

    With regard to the Game Dev licenses,  there is one that covers Daz Originals  (anything that has Daz 3D as one of the vendors on the store page) anf there are separate licenses for those PAs who allow their products to be used in games.   Not all the PAs do.
