Hello, new guy here.
I would am currently working with a freelancer to make a few models for an upcoming project.
He said that he will take the Genesis 3 base model, and sculpt/design it how I need and will use in my freemium app.
Besides paying him for the work, can you please explain if any fees are needed to pay to Daz3D?
I saw a few lines about if above or under $100k. I read the EULA a few times, and it did not explain clear enough to me Daz3D's pricing model.

You would both need licenses for the content (that is, to have purchased it from the store). You, as the publisher, would need an interactive license for the content that was to be included (as 3D data) in the game. If this is "fremium" you need to note that the license does not allow the in-game purchase of add-on items created using Daz content - it covers only content that is accessible within the original game without an additional purchase from or fee to you.
The old Game Developer Licenses, which covered all of the items from the given PA, had two versions based on earnings but the current Interactive licenses are the same for all users.
I do not understand you fully. We will be creating off the Genesis 3 base model, so nothing would be purchased from the store.

Freemium wise, people will be purchasing the ability to use and move around with the character that they like most. There will not be any assets from the store.

For the bases you need a daz Studio license.

I'm not clear what users would be buying, but if it's a derivative of the Daz content (even if it's a diffrent derivative of the same base content as included in the free game) it would not be permissible. If the purchaseable add-ons are not content, or not content derived from Daz assets, then that is not an issue.

Regarding daz Studio license, where would I purchase a license for this?
Clicking on the "Genesis 3 Starter Essentials", I see now that the license is $50.
Customers of mine would download my app from the app store for free, open the game and the first screen would ask them which character they want to use in the game (some of which will cost money to use for that one time). Characters will simply be different variations of the base model that the freelancer will make himself (nothing additional from the asset store).
Please advise is $50 will be the total cost to have these characters in my game.

From what you've described, you're going to have folks paying (above the cost of the base game, which is free) for content that is derived from the Genesis 3 models. That's not allowed by any license DAZ offers.

Yes, the Morph3D license seems to not have the relevant section:
That said, you could definitely ask for consent. That's entirely an option, as I believe that clause was specifically added to avoid folks selling stuff on Second Life. But it's up to them as to whether they give an exception.

I think you guys are confused by what I am trying to do.
To give an annalogy, lets say I am making a third person shooter video game. I am making it so if you pick the muscle characher with the bigger gun, it would cost, rather than the little guy with a sword which comes for free. This is a normal business model for shooter video games and how studios make money and grow a business.
Again, please advise if this is possible.
Nobody's confused. For some reason, DAZ specifically disallows people from doing this, which generally prevents their assets from being used in any kind of freemium or microtransaction-incorporating game (that revolves around cosmetics, anyway).
Interesting. I will take it with their Sales Support team to hear their side of it.

In general, if your application needs to display content such that the content can easily be extracted in its original form, then you'll need a license to use content that you don't own copyright to. This includes vector-based artwork, fonts, 3D models and anything else in "original form".
If instead your content is in an "output" format, no licensing is needed (unless of course there are even stricter usage rules for said content). So if you render stills of the 3D model, create images containing bitmapped versions of the fonts, etc, you're generally a-ok.
Note that there are other things to keep in mind too such as trademarks, trade dress, using images you don't own copyright to, etc.
If you can, it's always cheapest to create your own content. There are then many different types of paid content. e.g. one-time royalty-free, per copy fees, etc.
